The Minimum Attorney Fee Tariff in Turkish Law

The Minimum Attorney Fee Tariff (MAFT), which determines the minimum amount that attorneys can charge for their services in the Turkish legal system, was published in the Official Gazette by the Union of Turkish Bar Associations on October 3, 2024, and entered into force.

This new tariff has been set by considering economic developments and inflation. The Minimum Attorney Fee Tariff is the fee schedule that attorneys must adhere to, and charging fees below this tariff would be in violation of both the law and professional ethical standards. Additionally, the Minimum Attorney Fee Tariff includes an average increase of 55.06%, taking into account the financial situation that emerged after the publication of the previous tariff regarding fixed fees.

The following fees have been subject to increases at varying rates, according to the statement made by the Union of Turkish Bar Associations:

  • The fee for contracted attorneys required to be employed in joint-stock companies under Article 35 of the Attorneyship Law has been increased to 32,000 TL.
  • The monthly attorney fee to be paid by private individuals and legal entities to their contracted attorneys has been regulated as a separate clause and set at 25,000 TL.
  • The fee for cases in the Civil Courts of Peace has been set at 18,000 TL, while the new fixed fee for cases heard in the Criminal Judgeship of Peace has been determined as 13,500 TL.
  • The fixed fee for cases followed in the Civil Courts of First Instance has been set at 30,000 TL.
  • The fixed fee for cases followed in the High Criminal Courts and Juvenile High Criminal Courts has been increased to 48,000 TL.
  • A new clause titled “Matters arising from non-compliance with rulings and injunctions on child delivery and the establishment of personal relations with the child” has been added to the tariff, with the fixed fee set at 12,000 TL.
  • The amounts specified in the third section of the tariff, titled “Fees for legal assistance related to monetary or monetarily assessable matters in judicial bodies and enforcement and bankruptcy offices,” have been significantly increased and restructured, taking into account the current financial conditions.

However, if the fee for the service subject to the third section is below the fixed fee, it will not exceed the principal receivable. 5.000,00 TL

For matters such as provisional attachment, provisional injunction, determination of evidence, suspension of enforcement, and determination of payment and deposit locations, provided that they are not part of an ongoing lawsuit:
